Terms of Service

1. Acceptance of terms

By creating an account or using Dracarium, you agree to these Terms of Service and the Privacy Policy. If you don't agree, please don't use the site.

2. What Dracarium is

Dracarium is a community book-tracking site focused on dragon and fantasy fiction — rate and review books, track your reading, follow other readers, keep a quote collection, message other readers directly, and build lists. Book data is sourced in part from the Google Books API and Open Library; we don't guarantee the accuracy or completeness of that data.

3. Eligibility

You must be at least 13 years old to create an account.

4. Your account

• Provide accurate information and keep your login credentials secure.
• You're responsible for activity that happens under your account.
• One account per person.
• We may suspend or terminate accounts that violate these Terms.
• If you turn on two-factor authentication, we strongly recommend enrolling more than one authenticator. Dracarium can't restore two-factor access automatically if every enrolled authenticator is lost — recovering the account at that point means reaching us through Support (Help & Contact) for manual review.

5. Your content

You keep ownership of what you write — reviews, quotes, diary entries, direct messages, and everything else. By posting content on Dracarium, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, reproduce, and display it as needed to operate the service — for example, showing your review to other readers, delivering your direct message to its recipient, or including your own content in your own data export.

This license ends when you delete the content or your account, except that we may retain copies for a reasonable time afterward for backups, legal compliance, or fraud prevention, and content already delivered to another reader (like a sent direct message) may remain on their side of the conversation. You're responsible for what you post, including making sure you have the right to post it.

6. Acceptable use

Don't:

• Harass, threaten, or abuse other users — including through direct messages.
• Impersonate another person or entity.
• Post spam, illegal content, or content that infringes someone else's rights.
• Attempt to bypass rate limits or security measures, or scrape the site with automated tools.
• Use the site for anything illegal.

See the Community Guidelines for more specific expectations, especially around direct messages and reviews. Reports go through a moderation queue, and we may warn, suspend, or remove content from accounts that violate these rules. If you believe a moderation decision was made in error, you can appeal it through Support (Help & Contact).

7. Intellectual property

The Dracarium name, design, and site code belong to its operator. Book titles, covers, and metadata belong to their respective publishers and rights holders, and are used here for reference and cataloging purposes.

8. Copyright complaints (DMCA)

Dracarium respects the intellectual property rights of others and expects readers to do the same. Quotes are capped at 1,000 characters — a deliberate limit meant to keep excerpts within fair-use territory rather than reproducing large portions of a copyrighted work.

If you believe content on Dracarium infringes your copyright, send a written notice to our designated agent that includes:

• Your physical or electronic signature (or your authorized agent's)
• Identification of the copyrighted work you claim is infringed
• Identification of the material you claim is infringing, and where it's located on the site
• Your contact information — address, phone number, and email
• A statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you're authorized to act on the copyright owner's behalf

Designated agent contact: to be added once registered with the U.S. Copyright Office. A reader who repeatedly posts infringing content will have their account suspended or terminated.

9. Third-party services

The site relies on third-party services — Google Books, Open Library, Supabase, Vercel, hCaptcha — that have their own terms and may change or become unavailable. We're not responsible for their availability or accuracy.

10. Disclaimer of warranties

Dracarium is provided "as is," without warranties of any kind. This is an independently-run project — we don't guarantee it will always be available, error-free, or permanent.

11. Limitation of liability

To the fullest extent permitted by law, the operator of Dracarium isn't liable for any indirect, incidental, or consequential damages arising from your use of the site.

12. Indemnification

You agree to indemnify and hold harmless Dracarium and its operator from any claims, damages, losses, or expenses — including reasonable attorney's fees — arising from your use of the site, your content, or your violation of these Terms.

13. Termination

You can delete your account at any time — see Privacy Policy, Section 5. We may suspend or terminate your access for violating these Terms.

14. Governing law and venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of Dracarium will be brought exclusively in the state or federal courts located in Utah, and you consent to that jurisdiction.

15. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and Dracarium regarding your use of the site, and supersede any earlier agreements on the same subject. Our failure to enforce any provision isn't a waiver of our right to enforce it later.

16. Changes to these terms

We may update these Terms from time to time; the effective date above will reflect the latest version.
